Arrests and Violations of the Law

All GCCC Students who are arrested are required to report their arrest to the Dean of Student Services within seventy-two hours (72) of release. Failure to accurately report an arrest is a violation of this Policy.

Alleged violations of federal, state, and/or local laws and/or city ordinances may be investigated and addressed under this Policy. When an offense occurs over which the College has jurisdiction, the College conduct process will usually go forward notwithstanding any criminal complaint that may arise from the same incident.

The College reserves the right to exercise its authority of interim suspension upon notification that a student is facing criminal investigation and/or complaint. Criminal investigations involving allegations of sexual assault, dating violence, domestic violence, and/or stalking will follow the emergency removal process as outlined in the Non-Discrimination/Anti-Harassment Policy. Interim suspensions, outlined below, are imposed until a hearing can be held, typically within two (2) weeks. Interim suspended students may request an immediate show cause meeting from the Vice President for Student Services to show cause why the interim suspension should be lifted or modified. This show cause meeting may resolve the allegation or may be held to determine if the interim suspension should be continued. The interim suspension may be continued if a danger to the community is posed, and/or the College may be delayed or prevented from conducting its own investigation and resolving the allegation by the pendency of the criminal process.

In such cases, the College will only delay its hearing until such time as it can conduct an internal investigation or obtain sufficient information independently or from law enforcement upon which to proceed. The College will make reasonable efforts to minimize the academic impact of the interim actions on the Respondent, as appropriate under the circumstances.

Student accused of crimes may request to take a leave from the College until the criminal charges are resolved. In such instances, the College procedure for voluntary leaves of absence is subject to the following conditions:

  • The Respondent must comply with all College investigative efforts that will not prejudice their defense in the criminal trial.
  • The Respondent must comply with all interim actions and/or restrictions imposed during the leave of absence.
  • The Respondent must agree that, in order to be reinstated to active student status, they must first be subject to, and fully cooperate with, the campus conduct process and must comply with all sanctions imposed.

Registered Sex Offenders - Any individual considered a sex offender by the federal or state judicial system is required to register this status with the College prior to enrollment. Failure to register with the College will subject the student to disciplinary action which may include probation, suspension, or dismissal from school. A copy of the documentation is kept on file at the GCCC Campus Police Department. A list of registered sex offenders in a community is kept on file with the local police department. The website address for Registered Sex Offenders in Kansas is https://www.kansas.gov/kbi/ro.shtml.
